This is the 2008 issue in this series of annual casebook.

There are now two more experts, one each from Hong Kong and Malaysia, who have joined the founder authors of this series in bringing to life, past decisions from the three Asia Pacific common law jurisdictions of Hong Kong, Malaysia and Singapore.

The selection of cases has been made with the view that the cases deal with issues that are important in connection with construction contracts, construction torts, and construction dispute resolution, and would interest and be useful to the stakeholders in the construction industry.

The selected cases have been presented with fronting commentaries. These commentaries have dealt with the key issues raised in the cases and the relevant legal principles that have been considered by the judges, offering the readers pertinent information for quick reference, a brief summary of the issues and their impact. Each commentary is followed by the case on the basis of ?as is?, allowing the judges? own words and reasoning lead the readers through the relevant legal doctrines and principles of law in detail.
